Disney has been hit with yet another lawsuit over a guest’s allergic reaction. This time the woman thankfully survived. Unlike the last time, this restaurant was owned by the Walt Disney Company.
Mae Bodziony (25) from Rhode Island filed a lawsuit in early july with the Orange County Circuit Court, claiming that she had an allergic reaction to a salad at Be Our Guest Restaurant in the Magic Kingdom. Bedoziony has a tree nut allergy, and she claims that she made them aware of this and was assured it would be fine.
Here is what is stated in the lawsuit,
“Mae, 25 years old, has a life-threatening allergy to tree nuts.
Mae informed the server about her allergies and ordered her meal from the allergen-free menu. The server confirmed that the items Mae planned to order were allergy-free.
The server brought bread and salad to the table, which the server assured the family was nut-free. Immediately after finishing the salad, Mae's lips became itchy. She then took two Benadryl pills. However, shortly thereafter, the reaction progressed, causing swelling in her throat.
Realizing she was having an anaphylactic reaction, Mae administered an Epipen to herself. The family informed the server about Mae's condition, who then asked if they wanted a team to respond. Another staff member also asked the family if they wanted a team to respond. A staff member escorted them to the Beasts' study to wait for an ambulance, which arrived in about 10 minutes and took Mae to AdventHealth Celebration Hospital in Kissimmee.”
The lawsuit states that her condition worsened at the hospital, which required medications and an overnight stay on a heart monitor, and after a rapid biphasic reaction, she needed to stay two more nights.
Disney never reached out to check on Ms. Bodziony to see if the family needed any assistance or, check on her condition.
Due to the situation, the family had to extend their car rental, and changed flights twice, which incurred fees.
The resort did extend their stay at no additional charge, but only after first offering a reduced rate for them.
After the ordeal, they were hit with a $40,000 hospital bill.
What is Ms. Bodziony asking for?
According to the filing, she is asking compensatory damages, punitive damages, and attorney fees due to negligence, medical bills, and emotional distress.
They are also asking for a trial by jury. Will Disney try to pull the “You signed up for Disney+” or “You used our My Disney Experience app, so you agreed to arbitration” move again?
In October 2023, Dr. Kanokporn Tangsuan died after consuming food in Disney Springs. She was also told the food at Raglan Road was allergen-free. The restaurant was located on Disney property, but it was owned and operated by another company that rented the space.
This time it is a Walt Disney-owned company.
